Please join the Sacramento Employer Advisory Council to gain valuable information regarding the ins and outs of Background Checks and Drug Testing.

Now more than ever before, employers are relying on background checks and drug testing of job applicants and employees to, among other things, maintain a safe and secure working environment and satisfy contractual and statutory requirements. In conducting these tests and investigations, however, companies still must navigate a complex maze of federal, state and local requirements and make certain business decisions about the associated legal risks.

We will discuss drug testing and investigative background check procedures to ensure they comply with federal, state and local discrimination and privacy laws, including Title VII of the Civil Rights Act of 1964 and the Fair Credit Reporting Act. 

Additionally, we will discuss how the Internet has opened up a vast network of publicly accessible information about job applicants and employees – and created new litigation risks, as well as how legalization of marijuana effects employers rights in California regarding drug testing.

·     Discusses the basic components of a drug and alcohol screening policy for applicants.

·     Explain post-hire testing including random and reasonable suspicion drug testing.

·     Review several recent changes in the application process that may make pre-employment inquiries unlawful including, ban-the-box legislation and equal pay act disclosures.

·     Discuss the proper process and notice needed to comply with background checks on applicants and adverse action letters.

 Our Speaker:

Adrian Hoppes

Adrian Hoppes is the newest associate to the McKague Rosasco LLP team, but she comes seasoned with employment law experience. Adrian knew she wanted to spend her career defending employers after spending over a decade with a Fortune 200 public utility operation with a workforce of over 20,000. She fulfilled many roles on the management team, including Human Resources and Labor Relations, with ever increasing responsibility. She handled personnel matters ranging from wage/hour analysis, FMLA/ADA compliance, EEO investigations, and disputes regarding contract interpretation and negotiations with labor unions. Adrian graduated law school in 2012 and now represents employers and managers in state and federal litigation, and in the defense of administrative complaints. With almost 20 years of combined experience, Adrian brings a keen understanding of the employment relationship with a practical approach to handling the complex legal requirements of California.
